Overview

Our staff counsel department is seeking a Sr. Trial Attorney to join our growing team in our Somerville or Mount Laurel, NJ offices.

As a member of our New Jersey Staff Counsel group, this attorney will be primarily responsible for handling the defense of claims made against professionals ranging from realtors, property managers, home inspectors, mortgage field services vendors, interior designers, and others. This attorney will be responsible for responding to demand letters, state and federal agency charges, and lawsuits which have been filed against Hanovers insureds. This attorney will also be responsible for investigation and management of assigned cases from the inception of the lawsuit until conclusion through dismissal, settlement, or trial, and working with adjusters and insureds to resolve claims as expeditiously and efficiently as possible. This attorney may also be called upon to assist with general liability matters as needed, and thus, experience in this area is preferred. This is a full-time, exempt role.

Responsibilities:

Independently conducts trials, depositions, pre-trial discovery, mediations, arbitrations or any other legal activity required to resolve cases.

Daily communications with claim professionals concerning the evaluations of legal files.

Provides legal advice to insureds and claim professionals as needed.

Negotiates settlements as directed.

Attends round tables.

Requirements:

Must be licensed to practice law in the state and federal courts in New Jersey. Pennsylvania license not required but would be considered a plus.

Must have a minimum of 5 years experience in miscellaneous professional liability litigation matters but may consider an

otherwise qualified candidate with lesser experience.

Jury trial experience preferred.

Must have a strong knowledge of current procedural and substantive law, as well as federal, state, and administrative agency rules.

Must demonstrate an ability to analyze issues, pro-actively develop effective strategies on pending cases, communicate regularly with claims professionals, document communications, and resolve cases as efficiently and effectively as possible.

Must have solid experience in preparing responsive pleadings, handling appearances, motion practice, and valuation of claims, settlement and trials.

Must be willing to work independently with minimal direction, handle claims efficiently, and be willing to travel as necessary. Advocacy: Solid knowledge and ability to defend complex cases. Negotiation Skills: Consistently influences claim outcomes through demonstration of effective negotiation techniques. Communication: Strong ability to deliberately and precisely exchange thoughts and opinions with one or more persons and to effectively translate legal language and ideas into layman’s terms. Decision Making: Strong ability to arrive at a determination in complex situations after careful consideration of facts and law without procrastination. Organization Skills: Strong ability to categorize and prioritize work and information to effectively and efficiently maximize productivity. Investigative Skills: Proficiency in following up step by step on inquiry or observation and search and examine with care and accuracy. Consistently able to take evidence that may be used in reaching a legal conclusion. Legal Research: Proficiency in locating and interpreting cases, codified laws and statutes. Ability to communicate reasonable and accurate conclusions and render opinion supported by current law. Courtroom Skills: Able to demonstrate appropriate courtroom behavior, attire and decorum and is knowledgeable of the rules and regulations that govern proceedings and conduct in courts of law or other legal forums and tribunals. Provides the highest professional service to clients and claims professionals. Career Development: Takes proactive responsibility for their career development. Maintains the necessary skill levels. Trial Skills: Has the ability to effectively present evidence and arguments of law to a judge or jury. Business/Industry: Has an interest and solid knowledge of current and possible future policies, practices, trends and information affecting The Hanover Insurance Groups businesses; Knowledgeable in the basic principles of property and casualty insurance.
