This position is located in the Division of Occupational Safety and Health, which is one of the largest of the National Office divisions in the Office of the Solicitor (SOL). The Division is responsible for the legal work arising out of the Department's administration and enforcement of, and the performance of related legal activities under, the Occupational Safety and Health Act of 1970 (OSH Act) as amended, and discrimination provisions contained within the International Safe Container Act of 1979; the Surface Transportation Assistance Act of 1982 (STAA); the Asbestos Hazard Emergency Response Act of 1986; and the Seaman's Protection Act (SPA), as amended by § 611 of the Coast Guard Authorization Act of 2010.

The incumbent serves as a paralegal specialist for the OSH Division and provides a variety of legal services to the staff attorneys:

Prepares and maintains the appellate docket for the counsels and Associate Solicitor. The docket serves as a detailed and readily accessible reference listing all active appellate matters (by case name and jurisdiction) and providing information about the attorney(s) assigned, issues involved, and procedural status for each case. Appellate proceedings in the OSH Division generally arise from enforcement actions, appeals from decisions rendered by the Occupational Safety and Health Review Commission (OSHRC), and challenges to OSHA rulemakings and other agency activity.

Reads all incoming mail for purposes of docketing and logs the complete sequence of events relating to appellate cases from initial filing to final disposition.

Establishes filing procedures and oversees the maintenance of the office filing system for all cases handled by the Division.

Independently identifies and describes issues in summary digest form.

Answers staff as well as public inquiries related to case assignments and due dates for appellate cases.

Assists staff attorneys and appellate counsels, as requested, in preparation for appellate litigation tasks. Assists attorneys with the preparation and filing of briefs and motions, including proofreading, checking citations and quotations, preparing tables of contents and authorities, assembling appendices in cooperation with staff attorneys, producing and binding of briefs and appendices, and overseeing the printing, service, and filing of hard copies.

Researches legal issues and precedents; uses standard and specialized sources to identify and research cases on specific points of law; handles legal research assignments, such as preparing a statute's legislative history.

Handles opening and closing of case files; prepares and organizes exhibits, case files, and records; reviews files and obtains documents for attorneys, as necessary.

Determines when motions and correspondence in routine matters are necessary; drafts appropriate documents and ensures that matters are satisfactorily resolved.

Initiates and maintains contacts with court officials and opposing counsels as appropriate in specific cases.

Serves as central point of contact on the upkeep of office law library, which may include federal codes and regulations.

Assists counsels and staff attorneys in other tasks as needed, including in the Division's enforcement and rulemaking activities and on implementing the Division's program for records management.

The selectee should be skilled in researching case histories and properly formatting citations to cases, statutes, executive orders, and regulations in legal documents; able to compile applicable statutes, decisions, and rulings for Division attorneys; and familiar with the Federal Rules of Appellate Procedure, administrative hearing rules, and local rules and working practices of the various federal courts.

For GS-9 level, applicant must have a Master's degree or equivalent graduate degree


2 full years of progressively higher level graduate education leading to such a degree or LL.B. or J.D., if related.


Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level in the Federal Service.

Applicants applying for the GS-9 must have one year of specialized experience equivalent to the GS-07.

Specialized experience is defined as proven ability in analyzing complex information, conducting legal research, preparing legal documents and exhibits, responding to inquiries from attorneys, judges and others regarding procedures, case requirements and case status.

For GS-11 Level, Applicants must have a PH.D. or equivalent doctorial degree.


3 full years of progressively higher level graduate education leading to such a degree or LL.M., if related.

Applicants applying for the GS-11 must have one year of specialized experience equivalent to the GS-09.

Specialized experience is defined as proven ability in analyzing complex information, conducting legal research, preparing and cite-checking legal documents and exhibits, responding to inquiries from attorneys, judges and others regarding procedures, case requirements and case status.

For this position, applicants may qualify using a combination of education and/or experience, if applicable. If an applicant chooses to utilize education in addition to or in lieu of experience, proof of successful completion of degree must be provided.
