THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT SALARY RANGE OF $ 84, 278 to $ 94,581. DOT funded. Salary offers are based upon the candidate’s education and experience related to the position, as well as departmental budget and equity considerations.

This position represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.

This position is not subject to the Fair Labor Standards Act.

The Attorney III represents the N.C. Department of Transportation in eminent domain litigation at all levels of complexity. The attorney has responsibility for all phases of litigation in land acquisition proceedings, including investigation, trials in the superior courts, and appeals to the Court of Appeals and the Supreme Court. The attorney provides legal advice and representation to the Right of Way Branch with respect to questions of law involved in appraisal and valuation of properties.

The primary duty of a trial attorney in this position is to represent the Department in the trial of eminent domain actions for the acquisition of real estate for highway purposes in cases where the Department’s Right of Way Branch has been unable to effect settlement with landowners, and legal proceedings have to be instituted.

This position requires travel and overnight travel.

In general the knowledge skills and abilities requirements are those for the general practice of law with heavy emphasis on litigation and civil jury trials; to effectively interact with clients, colleagues, juries, court officials and the general public; and to supervise colleagues. The knowledge, skill and ability to assimilate complicated and large amounts of information, to organize it and present it effectively orally and in writing is also required.

Must be highly proficient in Microsoft Word and capable of creating Powerpoint presentations.

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
