OVERVIEW

Oversee and lead all aspects of litigated matters and government investigations involving the Company (with the exception of IP and labor/employment)

MAJOR ACCOUNTABILITIES

  • Serve as trusted advisor and resource to the General Counsel, senior management, the Board of Directors and the businesses on litigation-related risks, risk avoidance and mitigation, and litigation resolution strategies, as well as government investigations.
  • Have primary responsibility over all (non-IP, non-labor/employment) litigation and threatened litigation, and government investigations, in coordination and consultation with the General Counsel and other Chief Counsels.
  • Oversee and manage Litigation Team, consisting of attorneys, paraprofessionals, and e discovery specialists.
  • Supervise and coordinate the Companys approach to litigation and government investigations by leading, engaging and directing internal and external resources.
  • Provide strategic input to outside counsel handling litigation and government investigations for the Company.
  • Prepare briefing materials for, and attend meetings with, senior management, the Audit Committee of the Board of Directors, and the Board of Directors regarding litigation and government investigations, as directed by the General Counsel.
  • Formulate and execute Companys strategies for managing and resolving mass tort and other complex litigation.
  • Manage Litigation Team spend, with special emphasis on strict budgeting oversight of outside counsel.
  • Collaborate/coordinate with Finance and other internal colleagues, as well as outside auditors and actuaries, regarding quarterly and annual disclosures, reserve setting, and cashflow projections.

KNOWLEDGE/SKILLS/BEHAVIORS

  • J.D. degree from an accredited law school with a strong academic record
  • Minimum 20 years law firm (preferably with an AmLaw 100 firm) or combined law firm/in-house practice with deep litigation experience, with special emphasis on the defense of product liability, class action, mass tort and other complex litigation, preferably with respect to medical device or other healthcare companies.
  • Combined law firm and in-house experience strongly preferred
  • Ability to work closely with and advise the General Counsel, all levels of management and the Board of Directors.
  • Demonstrated effectiveness in managing seasoned professionals, including outside counsel, and a commitment to inclusion and diversity in hiring and advancing Litigation Team members and outside counsel.
  • Ability and willingness to meet BDs expectations for its leaders, including the concept of servant leadership.
  • Ability to formulate and execute creative solutions for managing/resolving mass tort and other complex litigation.

QUALIFICATIONS

  • Currently admitted to practice law in NJ.
