The General Counsel strategically directs the Legal Services Division. This direction is consistent with state leadership and agency goals focused on health care delivery, innovation and payment reform to improve outcomes, contain costs and ensure program accountability and sustainability. Additionally, this position contributes legal recommendations and counsel to the Executive Leadership Team as well as the Board of Directors on the agencys regulatory and compliance efforts, potential challenges, and strategic direction.
*Under statutory authority, directs the legal function of representation of the Oklahoma Health Care Authority in federal and state court involving litigation of cases by and against the OHCA regarding the Medicaid program.
*Ensures compliance with state and federal law and regulations, agency policy and procedures. Works proactively to establish standards and implement procedures to ensure that compliance programs throughout the agency are effective and efficient in identifying, preventing, detecting and correcting noncompliance with applicable laws and regulation.
*Provides legal advice to employees of the Authority, specifically including the OHCA leadership team and Board of Directors.
*Negotiates, drafts and reviews contracts for the agency. Ensures contracts are procured through the appropriate methods (i.e., competitive bid, sole source agreements, etc.) in accordance with the Central Purchasing Act.
*Provides legal advice to agency employees and the Board of Directors regarding compliance with the Open Records Act, the Open Meetings Act during applicable public meetings. Drafts agendas so that agency business can be conducted.
*Assigned responsibilities involving planning, organizing, developing, coordinating, managing and controlling the operations of a division.
*Works independently to analyze and evaluate data, manage and supervise projects and staff concerning the daily operations of the division.
*Plans, coordinates, and supervises the daily operation of the Legal Services division through direct consultation and coordination with staff attorneys, paralegals, Human Resources and Civil Rights staff, and other employees involved in agency legal matters.
*Coordinates and promulgates current and long range goals, objectives, budgets, and policies for the Legal Services division as well as for the Authoritys agency-wide operations, subject to approval by the Chief Executive Officer and/or executive staff.
*Advises agency managers, directors, Human Resources staff, employees and others concerning provisions of the Oklahoma Personnel Act and the Merit Rules for Personnel Administration and employment law.
*Reviews and analyzes information from reports, studies, projects and visits from various state and federal organization for immediate and long range Authority program development; participates in top level management meetings involving the formulation and implementation of programs and policies and the development of proposed legislation.
*Represents the agency before the Oklahoma Legislature, employee groups, other state agencies and organizations, and nationally as requested; serves on special committees or boards as required.
*Provides legal advice on a wide range of issues including Medicaid laws and regulations, administrative rulemaking, contracts, civil rights and other human resources-related laws, etc.
*Represents the Authority, CEO and Board in state and federal courts in all litigation matters.
*Provides advice regarding state and federal legislation for program changes to the Medicaid Program.
*Other duties as assigned.
TRAVEL: Travel on an as needed basis.
SUPERVISORY RESPONSIBILITIES: Supervises the Legal Services Division.
EDUCATION AND/OR EXPERIENCE:
Juris Doctorate Degree from ABA accredited Law School AND License to practice law in Oklahoma or licensed in another state and eligible to sit for the bar exam in Oklahoma AND Bachelors Degree in a field related to the public delivery of health care, including, but not limited to Medicine, Law, Public Health, Health Care Administration, Business Administration, Accounting, Public Administration, Finance, Economics, Computer Science AND Nine (9) years in the practice of law.
PREFERENCE MAY BE GIVEN TO CANDIDATES WITH:
*Experience in the field of Medicaid, health care, and/or Managed Care regulations or operations.
*Advanced education in Public Health, Health Care Administration, Business Administration, Public Administration, or closely related field.
*Certification related to health care, HIPAA, security, privacy, and/or regulatory compliance.
