Risk Management


The Liability Attorney oversees the legal defense of all lawsuits brought against Publix. This includes the management of general liability, commercial auto, pharmacy, consumer class actions and other lawsuits. The incumbent develops and improves processes and policies for litigated and attorney-represented claims, manages outside counsel, controls legal costs and fees, and provides legal counsel to Risk Management, Publix leadership and internal claims units. The Liability Attorney reports to the Director of Liability Claims in Risk Management.
Additional responsibilities include:
 identifies and monitors high risk, high exposure lawsuits, oversees litigation strategies, monitors trials, assists outside counsel with unusual or complex issues and analyzes appellate issues
 manages the business relationship between Publix and its General Liability and Auto Liability Law Firms, including assessing the cost and quality of legal representation
 supervises two (2) General Liability Coordinators working on information requests, discovery and small claims matters
 communicates with Publix business units and managers on specific cases in litigation and risk management related questions
 supervises indemnification or subrogation issues arising from general liability or auto liability claims
 identifies and supervises Publixs cost mitigation efforts involving General Liability and Auto Liability Litigation
 identifies processes for improvement and participating in improvement efforts.

Required Qualifications

 Bachelors Degree and Law Degree (Juris Doctor)
 four (4) years of legal experience as an attorney in a litigationrelated field and
 five (5) years of legal experience as an attorney in a litigation practice concentrating on tort and personal injury defense litigation, including premises liability, negligent security, commercial automobile liability, pharmacy or medical malpractice including having had primary and direct responsibility for handling cases in these areas and
 experience serving as trial counsel (as lead or second chair) or
 three (3) years of legal experience as an attorney in a litigation related field and
 two (2) years of experience with Publix, managing litigation for an insurance carrier, third-party administrator, or a corporate liability claims function
 active BAR admission in one state at which Publix operates
 ability to travel, including overnight travel
 willing to work 45 hours/week

Preferred Qualifications

 Bachelors Degree in Risk Management, Business, Finance, Accounting, Insurance or related analytical discipline with a Juris Doctor or
 MBA with a concentration in Finance or related discipline with a Juris Doctor
 four (4) or more years of litigation management experience of tort claims
 five (5) or more years of legal experience in tort and personal injury litigation in South Florida
 experience in a Risk Management, claims, or insurance environment
 experience in legal fee cost control, outside legal counsel management, alternative fee arrangements
 experience managing outside counsel in tort or insurance defense litigation
 knowledge of legal billing and law firm management practices
 experience as lead trial counsel (first chair) in State or Federal Court civil trials
 experience working in the legal department of a corporation or claims department of an insurance company or third-party claims administrator
 legal management experience including pertinent functional responsibility
 experience in a Risk Management, claims, or insurance environment, including familiarity with risk analysis, claims adjusting and insurance /risk transfer concepts
 experience developing processes or reference and procedures for use by companies or law firms
 Associate of Risk Management or Certified Claims Representative Designation
 active Bar admission(s) in Florida and other states in which Publix operates.

Potential Annual Pay with Bonus

127,140 – 190,255

Year End Bonus

As a year-end bonus to associates, Publix issues one months extra pay (pro-rated in the first year) each year if associate remains employed through issue date of the bonus check that year. This is calculated as a 13th month of pay in the Potential Annual Pay with Bonus line above.
