Work under the general oversight of the Chief Executive Officer. Advise internal staff and interact with external parties on all legal and risk management issues, including but not limited to: contracts, corporate business issues, medical staff affairs, tax-exempt organization issues, real estate transactions, strategic partnerships, litigation, employment, information services, public relations and maintenance of governance documents such as bylaws, corporate charters and resolutions. Utilize the Risk Management principles of identifying, investigating, analyzing, and evaluating risks and the selection of the most advantageous methods of correcting, reducing or eliminating identifiable risks that may adversely affect our patients, visitors and employees or the quality of care provided to patients through our health care organization. Lead the organization in a comprehensive Compliance Program and will define and implement a structure that will ensure Corporate Compliance.
Essential Job Responsibilities
Demonstrate legal knowledge in the areas of healthcare law, contract law, mergers and acquisitions, real estate, probate, employment, criminal matters and medical malpractice.
Research and provide legal opinions concerning health care operations including, but not limited to, contracting, federal and state laws and regulations, and CMS compliance.
Work collaboratively with outside counsel, police, and/or other administrative agencies as necessary.
Responsible for the development and oversight for all aspects of the Risk Management Program.
Collaborate with Quality regarding patient safety issues.
Interact with any patient/ family member who has complaints or grievances against the hospital and/ or its personnel when necessary and offer guidance when possible in order to eliminate or diminish potential liability claims.
Provide Risk Management and/ or Claims Management information to the Board of Trustees, Medical Executive Committee, and Quality Committee of the Board.
Responsible for all aspects of claims administration, as set forth in the Risk Management Program.
Responsible for insurance related activities including self-insurance, purchasing of insurance, involvement in the selection of vendors, brokers, companies.
Will serve as the Compliance Officer and oversee the Corporate Compliance Program to ensure the organization evaluates and reviews compliance issues/concerns and that the organization is in compliance with rules and regulations of regulatory agencies, company policies and procedures, professional standards and accepted business practices.
Demonstrate knowledge of and supports hospital mission, vision, value statements, standards, policies and procedures, operating instructions, confidentiality statements, corporate compliance plan, customer service standards, and the code of ethical behavior.
Essential Job Qualifications (Knowledge, Education, and Training Requirements)
J.D. with current Michigan license.
Minimum of 5 years experience in health care law; experience in risk management preferred
Experience interacting with Executives and Trustees.
Ability to work with and or lead legal and business teams.
Able to exert up to 10 pounds of force occasionally (up to 1/3 of the time)
Able to lift, carry, push, pull, up to 10 pounds occasionally
Able to sit for the majority of the time, but may involve brief periods of time involving walking or standing.
Able to use keyboard frequently (1/3 to 2/3 of the time)
