Job Description and Duties

The Department of Health Care Services, Office of Legal Services, is recruiting to fill one permanent, full-time Attorney III position on the Behavioral Health Care Services team.

Under the direct supervision of the Senior Assistant Chief Counsel and the Civil Service Assistant Chief Counsel, and the general direction of the Chief Counsel, Deputy Director of the Office of Legal Services, the Attorney III will be responsible for providing a broad spectrum of legal advice on diverse and complex legal issues concerning Mental Health Programs and Substance Use Disorder Programs, including the Medi-Cal Program and other public behavioral health programs.

Duties include: Performing difficult legal research and analysis of federal and state laws and regulations on issues relevant to the DepartmentĀs development and implementation of Mental Health and Substance Use Disorder Programs, funded through the Medi-Cal program as well as other sources such as tax revenues; researching and analyzing a variety of legal issues and drafting memoranda to support policy development and implementation; researching and analyzing proposed federal and state legislation and drafting language options to align with department policy; researching and analyzing the effect of legislative changes and their implementation; analyzing and drafting regulations with clarity and precision and working with clients to implement those regulations; providing advice to program partners regarding litigation avoidance and strategy; reviewing, analyzing and drafting contracts language; advising on licensing violations as well as creating licensing schemes and implementing them; and, performing other special projects and work as required.

Effective July 1, 2020, in response to the economic crisis caused by the COVID-19 pandemic, the State of California implemented the Personal Leave Program 2020 (PLP 2020). As a result, full time DHCS positions are subject to a 9.23% reduction in pay, in exchange for 16 hours PLP 2020 leave credits. Part time and intermittent position compensation will be on a pro-rated basis.
