Bankruptcy Senior Counsel/Sr. Manager

The Role:
As Bankruptcy Senior Counsel on the Regulatory Advisory Team in Capital One’s Legal Department, the attorney in this position will work closely with the Auto Finance bankruptcy operations teams to provide legal guidance and to ensure compliance with internal policies and procedures and various bankruptcy laws and regulations. The Senior Counsel will serve as the primary bankruptcy counselor advising Capital One’s Auto Finance bankruptcy operations groups and related support groups. The Senior Manager, Senior Counsel will be responsible for providing strategy and overseeing various bankruptcy litigation, including, but not limited to, dischargeability and preference litigation, and/or other consumer regulatory, bankruptcy litigation. The Senior Counsel will be part of a dynamic, energetic team and report to the Director, Assistant General Counsel – Bankruptcy.
 

This role requires an attorney with experience in  consumer regulatory and bankruptcy law, preferably Chapter 7 or Chapter 13 related litigation.  The role requires an attorney with intellectual curiosity, a desire to learn new areas of law, and an interest in an ability to analyze and interpret laws, regulations and other source documents covering many different areas of the law. This role also requires an attorney with a strong interest and proficiency in the use of modern technology, and with strong analytical, organizational, and prioritization skills. Additionally, this role requires an attorney possessing excellent verbal and written communication skills, attention to detail, the ability to interact with and influence associates across departments and job levels, and the ability to work effectively in a fast-paced environment, with minimal supervision, while managing large volumes of work including complex legal issues that may arise suddenly.
 

  • Responsibilities:

    • Serve as the legal counselor advising Capital One’s Auto Finance operations groups and related support groups (e.g., Legal, Compliance, Risk, Audit, and Quality Assurance).

    • Support the Auto Finance bankruptcy operations groups as an integral member of their operational and risk management processes.

    • Provide strategic and proactive leadership on legal and regulatory issues affecting the Auto Finance businesses.

    • Ensure timely identification, mitigation, resolution and reporting/escalation of existing and emerging legal issues and risks.

    • Support the development, marketing, and rollout of new products, services, and other innovations impacting customers being serviced by the Auto Finance bankruptcy operations groups.

    • Review internal policies and procedures and advise Capital One’s Auto Finance bankruptcy operations groups on best practices, policies and procedures.

    • Build and maintain effective working relationships with internal and external stakeholder groups.

    • Must be based in Plano, TX and will report to Director, Assistant General Counsel – Bankruptcy.

  • A successful candidate will have:

    • Deep expertise in consumer bankruptcy laws and regulations affecting credit card and retail bank products and services.

    • At least 2 years of robust bankruptcy litigation experience, including, but not limited to, proof of claim, dischargeability, preference, mortgage, and auto finance litigation, and/or other consumer regulatory, credit card and retail banking-related bankruptcy litigation.

    • Financial services industry knowledge and expertise, including experience with consumer regulatory requirements relating to credit card and retail bank products and services.

    • A thorough knowledge of consumer protection laws, including TILA, ECOA, UDAAP, FCRA, FDCPA, SCRA, Dodd-Frank Act, and other accompanying regulatory consumer lending regulations.

    • Ability to work in a fast-paced environment with minimal supervision.

    • Ability to manage large volume of work, including complex legal issues that may arise suddenly.

    • Ability to thrive in an environment primarily defined by close collaboration with the businesses and Legal colleagues to solve complex legal issues and to develop guidance and advice.

    • Ability and willingness to work as a team player, with comfort interacting with associates across departments and job levels, both inside and outside the Legal department.

  • Basic Requirements:

    • Juris Doctorate (JD) with admission to at least one state bar

    • At least 5 years of experience as an attorney in a law firm, an attorney within an in-house legal department, or government experience in an attorney role
    • At least 2 years of experience working with consumer bankruptcy laws impacting banking products, including auto finance

  • Preferred Requirements:

    • 6+ years of law firm, in-house legal department, Chapter 7 or Chapter 13 trustee representation, or government experience in an attorney role

    • 3+ years of experience working on consumer regulatory matters, with an emphasis on auto finance

    • 3+ years of experience as an attorney within a regulatory environment

    • Experience with Microsoft Excel, Microsoft Word, Microsoft PowerPoint, G-Mail, Google Documents, Google Sheets, Google Slides and Salesforce
