Job Description and Duties

Under general direction from the General Counsel and Assistant General Counsels for the Legal Affairs Office, Legal and Audits Branch, the Attorney III represents the California Department of Education, the State Superintendent of Public Instruction, and the State Board of Education in all litigation in all federal and state courts, and all administrative tribunals including the U.S. Department of Education, the Education Audit Appeals Panel, the California State Personnel Board and the Office of Administrative Hearings. 

• Represents the California Department of Education, the State Superintendent of Public Instruction and the State Board of Education, and its members, in all litigation in federal and state courts. Handles all facets of complex litigation, ranging from motions and discovery through trial. Researches and prepares all written pleadings, arguments, and proposed orders in connection with assigned litigation.

• Researches and prepares appellate briefs in federal and state appellate courts on behalf of the California Department of Education, the State Superintendent of Public Instruction and the State Board of Education.

• Researches and prepares memoranda and opinions upon request of the State Board of Education, and its members, the State Superintendent of Public Instruction, and staff of the California Department of Education.

• Researches and drafts legal advisories relating to issues having statewide educational impact for dissemination to all K-12 school districts and all county offices of education.

• Researches, prepares, and submits amicus curiae briefs on items of significant state and national educational concern to all federal and state appellate courts on behalf of the California Department of Education, the State Superintendent of Public Instruction, and the State Board of Education and its members.

• Analyzes appellate court decisions and advises the State Board of Education, and its members, the State Superintendent of Public Instruction, and the staff of California Department of Education of the legal impact of the decisions.

• Represents the California Department of Education, the State Superintendent of Public Instruction, and the State Board of Education, and its members, in all matters before all administrative tribunals including the United States California Department of Education, the Education Audit Appeals Panel, the California State Personnel Board, and the Office of Administrative Hearings.
